Terms of Service

These Terms of Service apply when you access or use ex.gold, including our website, marketplace pages, seller storefronts, product listing pages, enquiry flows, sign-in features, support channels and related services.

By using ex.gold, creating an account, publishing a storefront, listing items, making an enquiry, placing an order or otherwise using any marketplace feature, you agree to these Terms. If you use ex.gold on behalf of a business, you confirm that you have authority to bind that business to these Terms.

If you do not agree to these Terms, you must not use ex.gold.

ex.gold is operated by SOLVED - FZCO , a company registered in the United Arab Emirates.

ex.gold is a marketplace experience for jewellery, bullion, precious metals and related items. The service may include curated browsing, vendor storefronts, product listings, live metal-rate references, enquiry flows, account features and seller tools.

Unless we expressly state otherwise, ex.gold provides marketplace technology and discovery tools. We are not the seller, buyer, broker, agent, valuer, jeweller, insurer, courier or payment intermediary for transactions between buyers and sellers.

Marketplace features may change over time. We may add, update, restrict, suspend or remove features, listings, storefronts or access where needed for product, legal, operational, security or trust reasons.

Some features may require an account. You agree to provide accurate information, keep it up to date and keep login credentials secure. You are responsible for activity under your account.

If you create or manage a seller storefront, you are responsible for access granted to your staff, contractors or other authorised users.

We may restrict, suspend or remove access where we reasonably believe an account is being misused, presents a security risk, breaches these Terms, violates law or may harm ex.gold, users, sellers or third parties.

Product information, availability, price indications, images, descriptions, weights, purities, certificates and delivery options are usually provided by sellers. You should check all important details with the seller before relying on them or completing a purchase.

Prices and availability may change quickly, especially where listings are connected to live or periodically updated metal rates. Displayed information may be delayed, incomplete or no longer current.

Any purchase, reservation, enquiry, collection, delivery, return, repair, warranty or after-sale arrangement is between you and the relevant seller unless we expressly agree otherwise in writing.

Sellers are responsible for the accuracy, legality and completeness of all storefront details, listings, prices, charges, images, availability, stock status, product claims, hallmark information, certificates, delivery terms, return terms and customer communications.

Sellers must only list items they are legally entitled to sell. You must not publish counterfeit goods, stolen goods, misleading listings, prohibited goods, infringing content or items that breach applicable law, payment-provider rules or marketplace standards.

We may review, remove, disable, de-rank or restrict storefronts or listings where we reasonably believe they breach these Terms, applicable law, third-party rights, provider rules or trust and safety standards.

ex.gold may show live, delayed or periodically updated precious-metal rates, currency rates, calculated prices, valuation references or price bands. These features are provided for marketplace context and may depend on third-party data sources.

Rates, calculations and displayed prices may be delayed, unavailable, inaccurate, incomplete or affected by market conditions, configuration errors, provider outages or seller settings.

ex.gold is not financial, investment, tax, valuation, insurance or legal advice. Buyers and sellers remain responsible for checking prices, weights, purities, taxes, charges and commercial decisions before acting.

Sellers and users retain ownership of content they submit, subject to the rights they grant us to host, process, display, promote, transmit, resize, back up and otherwise use that content to provide, secure and improve ex.gold.

You must have the rights needed to upload or publish any product images, descriptions, branding, logos, certificates, documents or other content. You must not upload unlawful, misleading, infringing, unsafe, offensive or inappropriate content.

ex.gold, including its software, design, interface, branding, workflows and marketplace content created by us, is owned by SOLVED - FZCO or its licensors and is protected by intellectual property laws.

The exact order, payment, delivery, collection, cancellation, return, warranty and refund terms for an item are set by the relevant seller unless ex.gold expressly provides a separate checkout or buyer-protection process.

If third-party payment, logistics, authentication, communication or identity services are used, those services may apply their own terms, policies, limits and availability.

You are responsible for complying with laws, taxes, duties, import or export rules, consumer obligations and trade restrictions that apply to your purchase, sale, listing, delivery or collection.

You must use ex.gold lawfully and responsibly. You must not:

• Use the service for unlawful, fraudulent, misleading, harmful or deceptive activities.
• Publish counterfeit, stolen, prohibited, unsafe or infringing goods or content.
• Misrepresent your identity, business, products, prices, stock, certifications, hallmarks or authority to sell.
• Interfere with, disrupt, overload, scan, scrape, attack or attempt to gain unauthorised access to the service.
• Upload malware, harmful code, spam, abusive messages or content that violates another person's rights.

ex.gold may use or integrate with third-party services, including hosting, authentication, analytics, mapping, communication, payments, rate-data providers, seller inventory tools and customer-support providers.

Third-party services may be subject to their own terms, policies, limits and availability. We are not responsible for failures, delays, outages, changes or acts of third-party providers outside our reasonable control.

We aim to provide a reliable marketplace experience, but we do not guarantee that ex.gold will be uninterrupted, error-free, secure or available at all times.

The service may be unavailable because of maintenance, upgrades, faults, security incidents, provider outages, network issues, force majeure events or other circumstances.

ex.gold is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee seller identity, item authenticity, item quality, availability, valuation, delivery, sale outcomes or dispute outcomes unless expressly stated in writing.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

To the maximum extent permitted by law, SOLVED - FZCO will not be liable for indirect, incidental, special, consequential, punitive or exemplary losses, or for loss of profits, revenue, goodwill, business opportunity, data, anticipated savings or business interruption.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to ex.gold or these Terms will not exceed the greater of AED 500 or the fees you paid directly to us for marketplace services in the three months before the event giving rise to the claim.

You agree to defend, indemnify and hold harmless SOLVED - FZCO, its affiliates, officers, employees and suppliers from claims, losses, damages, liabilities, penalties, costs and expenses arising from your breach of these Terms, your listings or content, your products, your transactions, your misuse of ex.gold, or your violation of law or third-party rights.

You may stop using ex.gold at any time. We may suspend or terminate access, remove listings or close accounts where we reasonably believe there is breach, legal risk, security risk, non-payment, misuse, provider-rule violation or harm to ex.gold, users, sellers or third parties.

After termination or account closure, your access may stop. We may delete, retain or anonymise information according to our Privacy Policy, retention practices, legal obligations and backup processes.

We may update these Terms from time to time. When we do, we will update the "Last updated" date above.

If changes are material, we may provide additional notice, such as by email, in-app notice or notice on the website. Your continued use of ex.gold after updated Terms become effective means you accept the updated Terms.

These Terms are governed by the laws of the United Arab Emirates, unless mandatory laws in your location require otherwise.

Subject to any mandatory rights you may have under applicable law, the courts of Dubai, United Arab Emirates will have jurisdiction over disputes arising out of or relating to these Terms or ex.gold.

Before starting formal proceedings, you agree to contact us and try to resolve the dispute in good faith. You can contact us at hello@ex.gold .

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations as part of a merger, acquisition, reorganisation, sale of assets, corporate restructuring or similar transaction.

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.

Our failure to enforce a right or provision does not mean we waive that right or provision.

These Terms, together with applicable policies and any agreed seller, checkout or account terms, form the agreement for ex.gold.
